MP Voicemail

· MP Voicemail Service (MPVMS) agrees to provide, and the Subscriber agrees to accept, the services as billed.

· Payment is required in advance. This Agreement will remain in effect as long as the necessary fees are paid. There will be no refund of prepaid fees should the subscriber decide to cancel prior to service expiration date.

· Accounts are due full by DUE DATE. As a courtesy, we offer a 10 day grace period with a $3 late fee if you pay past your due date. After 10 days your number will be suspended. After 15 days, service will be disconnected without notice and any messages not retrieved will be discarded.

· MPVMS will use its best efforts to maintain uninterrupted service. In the event of a power failure, completed messages will be maintained in storage. Calls in progress at the time of a power interruption may be lost. MPMVS is not responsible for uncompleted or unretrievable messages as a result of power and/or equipment failure, and because damages cannot be calculated in advance, Subscriber agrees that the maximum award for damages for any reason will be equal to one (1) month’s basic service charge. In no event shall MPVMS be liable in excess of one (1) month’s basic service charge and in no event shall MPMVS be liable for any special or consequential damages. Subscriber agrees that these liquidated damages are reasonable under the circumstances existing at the time this contract was made

· MPVMS retains the right to refuse service to anyone who fails to pay a bill or uses voicemail for solicitation, obscenities, illegal activities or harassment.
